1. Acceptance of Terms

By accessing or using XP ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. XP is a gamification application designed for use within the Whop platform.

2. Description of Service

XP provides gamification features for Whop communities, including but not limited to:

  • Points and XP tracking for member activities
  • Level progression systems with customizable badges
  • Streak tracking with freeze protection
  • Leaderboards (weekly, monthly, and all-time)
  • Analytics and engagement insights for community owners

3. Account and Access

To use XP, you must have a valid Whop account. Community owners can install XP on their Whop communities. By installing or using XP, you represent that:

  • You are at least 13 years of age
  • You have the authority to bind yourself or your organization to these terms
  • Your use complies with Whop's Terms of Service

4. Subscription Plans and Payments

XP offers the following subscription tiers:

  • Free: Up to 50 members, basic features, XP branding displayed
  • Starter ($19/month): Up to 250 members, custom levels & badges, advanced analytics, no branding
  • Pro ($49/month): Unlimited members, unlimited customization, priority support

Payments are processed securely through Stripe. Subscriptions automatically renew unless cancelled before the renewal date. Refunds are handled on a case-by-case basis.

5. Member Limits

Each plan has a member limit. When you exceed your plan's member limit, new members will not be tracked by XP until you upgrade. Existing tracked members will continue to accumulate XP. We recommend upgrading before reaching your limit to ensure all members are tracked.

6. Acceptable Use

You agree not to:

  • Use XP for any unlawful purpose or in violation of Whop's Terms of Service
  • Attempt to manipulate XP, points, or leaderboards through automated means or exploits
  • Interfere with or disrupt the Service or servers
  • Reverse engineer, decompile, or attempt to extract source code
  • Use the Service to harass, abuse, or harm others
  • Resell or redistribute the Service without authorization

7. Intellectual Property

XP and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, and other intellectual property laws. You retain ownership of any content you create within your Whop community.

8. Data and Privacy

Your use of XP is also governed by our Privacy Policy. By using XP, you consent to the collection and use of information as described in our Privacy Policy.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may modify, suspend, or discontinue any aspect of the Service at any time. We will provide reasonable notice for significant changes that affect your use.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

12. Indemnification

You agree to indemnify and hold harmless XP and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of these Terms.

13. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service will immediately cease.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the updated Terms on this page with a new "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions.
